What tensions arise between data protection and the need for traceability in the monitoring of vulnerable populations?

The strengthening of social protection systems in Latin America requires the consolidation of dynamic, interoperable social registries capable of continuous monitoring of vulnerable populations. However, the need for traceability to guarantee comprehensive care for children and adolescents, people in human mobility, and other priority attention groups raises significant tensions with the fundamental right to personal data protection. In the Ecuadorian case, the implementation of the Organic Law on Personal Data Protection (2021) and its Regulation (2023) introduces legal and technical obligations that challenge traditional mechanisms for registering and monitoring high-risk populations. The objective of this article is to analyze these tensions from a legal, institutional, and ethical perspective, using a qualitative methodology based on normative review and comparative analysis, incorporating references from the European Union’s General Data Protection Regulation (GDPR) and international guidelines on sensitive data governance. The findings show that traceability processes can conflict with the principles of minimization, proportionality, and purpose limitation, especially when multiple institutions intervene and require continuous access to sensitive information. It is concluded that traceability can be strengthened if it is articulated with a rights-based approach, risk management models, and secure interoperability mechanisms that allow progress toward responsible traceability.
